Infringement Warning

BookRiff Media Inc. ("BMI") respects the intellectual property of others, and BMI expects all users of the BookRiff.com website (the "BookRiff Site") to do the same.  Allegedly infringing materials on the BookRiff Site may be removed or suspended at any time in accordance with the Terms of Service.  Repeated infringement by a user of the BookRiff Site may, in appropriate circumstances, result in a termination of that user's access to and use of the BookRiff Site.

Notification of Infringement

If a party believes that any of its work has been copied or published or has otherwise been used in connection with the BookRiff Site in a way that constitutes copyright infringement or is otherwise an infringement of its intellectual property rights, please provide BMI's designated agent for notice of claims of copyright or other intellectual property infringement (the "Copyright Agent") with the following information (the "Infringement Notice"):

1.  an electronic or physical signature of the person authorized to act on behalf of the party;
   
2. a description of the copyrighted work or other intellectual property that the party claims has been infringed;
3. a description of where the material that the party claims is infringing is located on the BookRiff Site, with enough detail that BMI may find it on the BookRiff Site; 
4. the party's or authorized representative's address, telephone number, and email address;
5. a statement by the party or its authorized representative that he/she has a good faith belief that the disputed use is not authorized by the party, its agent, or the law; and
6. a statement by the party or authorized representative, made under penalty of perjury, that the above information in the party's notice is accurate and that the party is the owner of the copyright or intellectual property and, if applicable, the authorized representative is authorized to act on the copyright or intellectual property owner's behalf.

Counter-Notification

If a User whose contributed content was removed or suspended by BMI due to notification from a party (the "Affected User") elects to send BMI a counter notification, to be effective it must be a written communication provided to BMI's Copyright Agent that includes substantially the following:

1. an electronic or physical signature of the person authorized to act on behalf of the Affected User;
2. identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
3. a statement by the Affected User, made under penalty of perjury, that he/she have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
4. the Affected User's name, address, and telephone number; and
   
5. a statement that the Affected User consents to the jurisdiction of the United States Federal Court in the district in which the Affected User's address is located or, if the Affected User's address is outside the United States, that the Affected User consents to any jurisdiction where BMI may be found, and that the Affected User will accept service if process originates from the party who provided the Infringement Notice or from the agent for such party.
